ECJ JUDGEMENT DATE ANNOUNCED

The European Court of Justice today announced Tuesday 27th November as the judgement date on Thomas Pringle TD’s challenge on the European Stability Mechanism (ESM) and the three questions referred to it by the Supreme Court.
“Today the ECJ has announced that they will give the judgement on my case on Tuesday 27th at 9.30am in Luxembourg, nearly a month earlier than expected.
“The three questions to be decided by the 27 judges of the ECJ, the first time all judges have participated in a case referred by a national court, are as follows:
- Is the ESM Treaty compatible with the EU Treaties?
- Is the amendment to Article 136 of the TFEU intended to facilitate the ESM lawful? One aspect of this question is whether it was permissible for EU Heads of Government to amend the TFEU by use of the simplified amendment procedure.
- Can Eurozone States join the ESM before the Article 136 amendment is in force?
“I also note with interest how the IMF is openly calling for debt reduction, with the Belgian representative on the ECB Luc Coene calling for this too, showing a growing discontent with the status quo regarding how the EU is ‘handling’ the eurozone crisis. This emerging shift has come at an important time in EU affairs, highlighting the need to address these concerns for the good of Europe and its people. Deciding on the legality of the ESM is an essential part of adequately tackling this crisis.
“I am looking forward to the judgement later this month by the 27 judges of the ECJ in the hope that this integral institution has left politics at the door of the court and has listened to the arguments to make a decision for the people of Europe and not the elites and bankers.”
